FAA ISSUES MAJOR NEW PROPOSED RULES
The Federal Aviation Administration (FAA) has issued a Notice of Proposed Rulemaking (NPRM) to, in part, "add notification requirements and obstruction standards for electromagnetic interference." The document occupies 18 pages of the Federal Register, and an attorney for one ofour clients provided the following analysis:
"We wanted to alert you that the FAA (has) announced its plans to establish a brand new set of rules for antenna towers and "radiating elements" that could create significant new burdens and delays for FM broadcasters and TV broadcasters operating on VHF channels. The new rules would go so far as to require 60 days notice and prior FAA approval to add a frequency to an existing tower or change certain radio frequencies, power or operating parameters (by, for example, replacing an old antenna with a new one)...."
There are also a number of other proposed rule changes. Comments are due September 11, 2006.
